1. The promoter
The Kinghorn Children's Gala Lottery (the Lottery) is a small society lottery promoted by Kinghorn Childrens Gala Committee, Scottish Charity SC011609 (we, us, the Society), and registered with Fife Council under the Gambling Act 2005. The promoter responsible for the Lottery is Kinghorn Childrens Gala Committee, 8 Orchard Road, Kinghorn, Fife KY3 9XN. Contact: [email protected].
All proceeds after prizes and expenses are used for the purposes of the Society: providing a week of activities for the children of the Parish of Kinghorn.
2. Who can enter
- You must be 18 or over. It is an offence for anyone under 18 to enter, or for anyone to enter on behalf of someone under 18.
- You must live in England, Scotland or Wales. The Lottery is not open to residents of Northern Ireland or anywhere outside Great Britain.
- Trustees of the Society and members of their households may not enter.
- You must enter for yourself, using a debit card in your own name.
- You must not enter if you have self-excluded from the Lottery and your exclusion is still in force.
We check the date of birth given with every entry and may ask for proof of age and identity at any time, and always before paying a prize. If we find an entry was made by someone under 18 or anyone not eligible, the entry is void, the payment is refunded to the card used and no prize is paid.
3. Entries and payment
- Each entry costs £1 per draw. Every entry costs the same.
- You may buy between 1 and 10 entries per draw, for 1, 4 or 13 consecutive weekly draws. No person may hold more than 10 entries in any one draw.
- Payment is taken in full by debit card when you enter. Credit cards are not accepted. There are no automatic renewals.
- An entry is only included in a draw once we have received payment for it. Entries close at 11.59pm on the Thursday before each Friday draw; entries received later go into the following draw.
- Each entry is given a unique 6-digit ticket number.
- Your entry confirmation is sent by email and shows the name of the Society, the name and address of the promoter, the price of the entry and the date of each draw.
4. Spending limits
You may set a monthly spending limit when you enter or at any time afterwards by contacting us. We will not accept entries that would take you over your limit. Requests to lower a limit take effect immediately; requests to raise a limit take effect 7 days after we receive them.
5. The draw
- Draws take place every Friday at 7pm. If a draw has to be moved, for example because of a public holiday or a technical problem, we will announce the new date on our website and by email to entrants, and the draw will be held within 7 days of the original date.
- The 1st, 2nd and 3rd prize ticket numbers are selected in that order by a computer random number generator from all valid, paid entries for that draw. Each ticket number can win only one prize in each draw.
- Each draw is witnessed by two trustees of the Society. A record of the entries, the result and the witnesses is kept for at least 3 years.
6. Prizes and odds
- 40% of the ticket sales for each draw forms the prize fund for that draw. The 1st prize is 50% of the prize fund, the 2nd prize 30% and the 3rd prize 20%, rounded down to the nearest penny.
- At least 50% of the ticket sales for each draw is applied to the purposes of the Society, which is above the legal minimum of 20%. No more than 10% is used for expenses.
- Prizes are cash only and there are no rollovers. No single prize will exceed the legal maximum for a small society lottery.
- The chance of any single entry winning a prize is 3 divided by the number of entries in the draw. For example, with 400 entries the chance of winning any prize is 3 in 400.
- The total value of entries for any one draw will not exceed £20,000 and the total for all our lotteries in a calendar year will not exceed £250,000.
7. Winners and prize payment
- We contact winners by email and phone within 2 working days of the draw.
- Before paying a prize we will confirm your identity and age, and may ask for photo ID and proof of address.
- Prizes are paid by bank transfer to an account in the winner's name within 14 days of successful verification.
- Prizes must be claimed within 90 days of the draw. Unclaimed prizes are applied to the purposes of the Society.
- Prizes cannot be transferred and no cash alternative or substitute is offered.
- We will never ask a winner to pay a fee to receive a prize.
8. Publicity
We publish the winning ticket numbers, the number of entries, the prize amounts and the amount raised for every draw. We only publish a winner's first name, initial and town if they have given their consent, which they can withdraw at any time.
9. Cancellations and refunds
You may cancel entries for any future draw by contacting us before 11.59pm on the Thursday before that draw. We will refund cancelled entries to the card used within 14 days. Entries for draws that have already taken place cannot be refunded. If we cancel a draw, all entries for that draw will be refunded.
10. Self-exclusion
You may ask us to exclude you from the Lottery for 6 months, 1 year, 2 years, 5 years or permanently. We will confirm your exclusion within 2 working days, cancel and refund any future entries, and refuse any new entries from you during the exclusion. An exclusion cannot be shortened. See our responsible gambling page for more information and free support.
11. Responsible gambling
We operate the Lottery in a socially responsible way, including a minimum age of 18, an entry cap of 10 per draw, debit-card-only payment, no automatic renewals, optional spending limits and self-exclusion. If you are worried about your gambling, call the National Gambling Helpline free on 0808 8020 133, 24 hours a day.
12. Complaints
If you have a complaint, please email [email protected] or write to us at 8 Orchard Road, Kinghorn, Fife KY3 9XN. We will acknowledge your complaint within 2 working days and aim to resolve it within 14 days. If you are not satisfied with our response, you may contact Fife Council's licensing team, which registers the Lottery, or the Gambling Commission.
13. Liability and changes
We are not responsible for entries that are not received because of technical failures outside our control, or for incorrect details provided by entrants. Nothing in these rules limits liability that cannot be limited by law. We may change these rules; changes will be published on this page and will not affect draws for which you have already paid without your agreement. Our decision on any matter relating to the Lottery is final, subject to your rights under law and the complaints process above.
14. Governing law
These rules are governed by the law of Scotland, and the Scottish courts have jurisdiction, although if you live elsewhere in Great Britain you may also bring proceedings in your local courts.
